These Terms and Conditions ("Terms") govern your use of www.arcadianmoon.com (the "Site") and any reservations, bookings, tickets, purchases, and services offered by Arcadian Moon ("Arcadian Moon," "we," "us," or "our") in Higginsville, Missouri. By using the Site or our services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

1. Eligibility and Alcohol

·  You must be at least 18 years old to use the Site or make a booking.

·  You must be 21 or older to buy, receive, or drink alcohol. We check valid photo ID and may refuse service to anyone.

·  We will not serve anyone who appears intoxicated. We may ask guests who are intoxicated or disruptive to leave.

·  Outside alcohol is not allowed unless we have approved it in writing.

·  Wine shipments need an adult 21 or older with valid ID to sign for them. We only ship where the law allows.

2. Reservations and Tables

·  Reservations are held for 15 minutes after the booked time and may then be released.

·  Large parties (more than 20 guests) may need a deposit or a set menu.

·  Please cancel at least 24 hours ahead. No-shows or late cancellations may be charged a fee if one was stated when you booked.

·  Seating, including lakeside seating, depends on availability and weather and is not guaranteed.

3. Events, Live Music, and Tickets

·  Tickets are non-refundable and non-transferable unless the event is canceled or we say otherwise.

·  If we cancel an event, we will offer a refund or credit. Events may go ahead in rain or move indoors. Performers, times, and programs can change.

·  We may refuse entry or remove anyone without a refund for unsafe, illegal, or disruptive behavior.

·  Events may be photographed or recorded. By attending, you agree that we may use images of the crowd for marketing.

4. Private Events and Weddings

Private events and weddings are covered by a separate signed event agreement. That agreement sets the deposits, payment schedule, minimums, guest counts, vendor rules, and cancellation terms. If it conflicts with these Terms, the event agreement controls.

5. RV Sites and Lodging Stays

·  Check-in / Check-out: Check-in from [3:00 PM]; check-out by [11:00 AM]. Late check-out depends on availability and may cost extra.

·  Deposits and Cancellations: A deposit of the first night is due when you book. Cancel 7 or more days before arrival for a refund minus a $6.5 processing fee. Cancellations within 7 days, no-shows, and early departures are not refunded.

·  Occupancy: Stay within the posted limits for guests and vehicles at each site or unit. Only registered guests may stay overnight.

·  RV Requirements: RVs must be self-contained and in good working order. Use only the assigned site and hookups. Do not dump grey or black water except at the approved facilities.

·  Quiet Hours: [10:00 PM – 7:00 AM].

·  Pets: Pets are allowed where posted. They must be on a leash, never left alone outside, and cleaned up after. Owners are responsible for any damage or injury their pet causes.

·  Fires and Safety: Fires are only allowed in the rings provided, following any burn bans. No fireworks. Firearms must follow Missouri law and posted rules.

·  Damage: Guests are responsible for damage beyond normal wear. We may charge the card on file for damage, extra cleaning, or broken rules.

·  Removal: We may end a stay without a refund for breaking these Terms, or for illegal, unsafe, or disruptive behavior.

6. Online Purchases, Gift Cards, and Wine Club

·  Prices and availability may change without notice. We may fix pricing errors and cancel orders affected by them.

·  Returns: Wine and food sales are final unless the product is damaged or faulty. Report problems within 7 days of delivery.

·  Gift cards cannot be exchanged for cash except where the law requires, cannot be replaced if lost or stolen, and are honored as Missouri law requires.

·  Wine Club: Members agree to recurring charges for each shipment or pickup until they cancel. You can cancel by giving notice 30 days before the next charge. Member benefits may change.

7. Payments

You agree to give accurate payment details, and you allow us to charge the amounts you agree to, plus any applicable taxes, fees, and gratuities. Large parties or events may have a service charge added automatically, and we will tell you ahead of time.

8. Use of the Site

You agree not to:

·  Use the Site for any unlawful purpose

·  Make false or fraudulent reservations or orders

·  Try to interfere with the Site, its security, or its servers

·  Copy, download, or reuse Site content in bulk by automated means without our permission

9. Intellectual Property

Everything on the Site belongs to Arcadian Moon or its licensors and is protected by law. This includes the Arcadian Moon name, logo, label designs, photos, menus, and text. You may not use it without our written permission.

10. Reviews and User Content

If you send or post reviews, photos, or other content to us or to our social channels, you allow us to use, reproduce, and display it without payment for marketing. You confirm that you have the right to share it.

11. Assumption of Risk

Our property is rural and lakeside, with uneven ground, open water, wildlife, insects, weather, and outdoor recreation. You take part at your own risk. Children must always be supervised, especially near the water. We do not provide lifeguards. Some activities may require a separate waiver.

12. Disclaimers

The Site and our services are provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied. We do not promise that the Site will always be available or free of errors. Allergen information is offered as a courtesy, and we cannot guarantee that any dish is free of cross-contact.

13. Limitation of Liability

To the extent the law allows, Arcadian Moon and its owners, employees, and agents are not liable for indirect, incidental, special, or consequential damages. We are also not liable for loss of, theft of, or damage to personal property or vehicles. Our total liability for any claim will not exceed the amount you paid us for the booking or purchase that led to the claim.

14. Indemnification

You agree to defend and hold harmless Arcadian Moon from claims, damages, and expenses (including reasonable attorney fees) arising from your breach of these Terms or from the conduct of you, your guests, or your pets.

15. Events Beyond Our Control

We are not responsible for delays or cancellations caused by events beyond our reasonable control. These include severe weather, flooding, fire, power outages, illness, government orders, or other emergencies. In those cases, we may offer a credit or a new date instead of a refund.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Missouri. Any dispute will be brought only in the state or federal courts serving Lafayette County, Missouri, and you consent to their jurisdiction.

17. Changes to These Terms

We may update these Terms at any time by posting a new version on the Site. Using the Site or our services after a change means you accept the updated Terms. The Terms in effect when you made a booking apply to that booking.
